These Terms of Service ("Terms") govern your access to and use of IMGC at imgur.cloud (the "Service"). By uploading content, creating an account, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 13 years old, or the minimum age required in your country, to use the Service. You are responsible for the accuracy of your account information, for keeping your password secure, and for all activity that occurs under your account. Notify us immediately of any unauthorised use.
2. Your content
You retain ownership of the images and other material you upload ("Your Content"). You are solely responsible for Your Content and for the consequences of uploading it.
By uploading, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, transcode and display Your Content solely for the purpose of operating, delivering and promoting the Service. This licence ends when you delete Your Content, except for copies retained in backups for a limited period or where retention is required by law.
You represent and warrant that you own Your Content or have all rights necessary to upload it, and that it does not infringe the rights of any third party.
3. Prohibited content and conduct
You may not upload, store, share or link to content that:
- Depicts child sexual abuse material (CSAM) or sexualises minors in any way. Such content is reported to the relevant authorities.
- Infringes copyright, trademark, privacy, publicity or any other right.
- Is unlawful, defamatory, harassing, threatening, or incites violence or hatred against individuals or groups.
- Contains malware, phishing material, or is used for spam or fraud.
- Depicts non-consensual intimate imagery, or real graphic violence or gore.
- Violates any applicable law or regulation.
Adult or otherwise sensitive content, where permitted at all, must be flagged as NSFW using the tools provided. You may not use the Service to run automated scraping, resell hosting capacity, hotlink at a scale that burdens our infrastructure, or circumvent any technical limit or security measure.
4. Advertising
The Service is supported by advertising. You agree that we may display advertisements alongside content, including on pages containing Your Content. You may not obscure, remove, click fraudulently on, or otherwise interfere with advertisements shown on the Service.
5. Moderation, suspension and termination
We may review, remove or restrict access to any content, and suspend or terminate any account, at our discretion and without prior notice, in particular where we believe these Terms have been violated. You may delete your content or close your account at any time.
6. Copyright complaints
If you believe content on the Service infringes your copyright, send a notice to [email protected] or use our contact page, selecting "DMCA complaint". Include: identification of the work, the URL of the allegedly infringing material, your contact details, a statement of good-faith belief, a statement that the information is accurate, and your physical or electronic signature. We remove infringing material and terminate repeat infringers.
7. Availability and no warranty
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, secure or error-free, or that content will be preserved. Keep your own copies of anything you value; the Service is not a backup service.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of data, profits, revenue or goodwill, arising from your use of or inability to use the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
9. Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss or expense, including reasonable legal fees, arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
10. Changes to these Terms
We may modify these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
